For Ben Robert Smith to be convicted it would have to be on the basis of witness testimony as there is unlikely to be any physical evidence after 20 years.
There is precedent for enemy testimony to be pivotal in post war trials but there would have to be scepticism about Taliban evidence. That only leaves evidence from Ben's own former comrades. Even amongst wrongdoers there is distain for so called "rats".
In political circles, particularly the ALP "rats" are never forgiven. In prison they need special protection. Given Ben's popularity any "rats" giving evidence might be held in very low esteem for the remainder of their lives so might need to give their evidence in secret.
