It shouldn't be a problem any more in that case. Gambling ads are now explicitly required to tell gamblers that they'll probably lose. "Chances are you're about to lose," and "You win some, you lose more" being the refrains broadcast in every gambling ad. There's nothing really beyond their own fantasy that tells a punter they'll probably win...other than the rare exceptions who actually do. All the conventional wisdom is that gamblers lose, including among gamblers I suspect.
