That's interesting, so just say it's the case and invoke the clause? Sounds like one could be leaving themselves a bit exposed (legally, that is).

I suppose it's all ok if it happens to someone you don't like? , might make it easier to justify?

Perhaps they should just put that in a clause, if we don't like you then we can terminate the agreement.
