Dateline considers that the reporting and the position advanced by the applicants, as described, do
not fully reflect the relevant historical context, including the status of valid existing rights associated
with the Colosseum Gold and Rare Earths Project, and the Company does not agree with the
assumptions made.

Importantly, activities at the Colosseum Gold and Rare Earths Project continue as planned, with
ongoing permitted activities being carried out in accordance with the Company’s Plan of Operations
and valid existing rights.

The Company will continue to monitor developments and will keep shareholders informed of any
material updates.
