As you rightly say, the tyre may show 5mmm tread depth which is legal but not good enough to stop some aquaplaning on "fat' tyres...pretty much an every day occurrence on a wet road.
And, buyers of constant 4wd type vehicles be aware that you can't just put a new tyre on a corner if one gets wrecked somehow. It is replace all 4 at the same tread depth or look forward to potentially damaging a "centre" diff, as it will be constantly operating at different revolutions front to rear.
I don't know about basic all wheel drives such as Mazda's, Volvo's, Honda's etc...but I would think any vehicle that drives all wheels at the same speed the circumference of every tyre will play a role.

Certainly you need have both front or both rear tyres the same and replaced at the same time, not so sure it is critical to replace all 4 at the same time.
Would piss you off to have to replace 4 tyres if one was damaged and they still had 70% tread if that where the case
